8. Intellectual Property Rights

Platform Content: The Platform and all content, features, and functionality (including but not limited to text, graphics, logos, and software) are owned by Bolt and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of the voice recordings and other content you submit through the Platform ("Your Content"). However, by submitting Your Content, you grant Bolt and our business partners a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content in connection with the Platform and our business partners' AI training purposes.

License Terms: This license continues even if you stop using the Platform, as AI models trained on Your Content cannot be "untrained." You represent and warrant that you have all necessary rights to grant this license and that Your Content does not violate any third-party rights.

9. Payment Terms

Compensation: You will be compensated for completed work according to the payment terms specified for each job. Payment amounts are determined by job complexity, duration, and other factors.

Payment Processing: Payments are typically processed weekly and transferred to your chosen payment method. A minimum balance may be required for withdrawal.

Taxes: You are solely responsible for determining and paying all applicable taxes on your earnings. Bolt will report payments to tax authorities as required by law.

Fees: Bolt may charge service fees or payment processing fees, which will be clearly disclosed. We reserve the right to modify our fee structure with notice.

Quality Standards: Payment is contingent on work meeting our quality standards. Work that does not meet standards may be rejected, and you may not be compensated for rejected work.

Disputes: If you dispute a payment decision, you must contact us within 30 days. We will review disputes in good faith but our decision is final.

10. Quality Control and Work Review

We implement quality control measures to ensure the integrity of AI training data. This includes:

  • Automated and manual review of submitted work
  • Quality scores and performance metrics
  • Random audits and spot checks
  • Feedback and improvement recommendations

Consistently low-quality work may result in reduced job opportunities, lower pay rates, or account suspension. We reserve the right to reject work that does not meet our standards, with or without providing specific feedback.

11. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. Key points include:

  • We collect and process your personal information as described in our Privacy Policy
  • Voice recordings and audio data are used for AI training purposes
  • We implement security measures to protect your information
  • You have certain rights regarding your personal data

For complete information about our data practices, please review our Privacy Policy.

12. Confidentiality

You may have access to confidential information about Bolt, our business partners, or AI training projects. You agree to:

  • Keep all confidential information strictly confidential
  • Not disclose confidential information to any third party
  • Use confidential information only for completing work on the Platform
  • Return or destroy confidential information upon request

Your confidentiality obligations survive termination of your account and these Terms.

13. Term and Termination

Term: These Terms begin when you create an account and continue until terminated by you or us.

Termination by You: You may close your account at any time through your account settings. You will be paid for all completed and accepted work.

Termination by Us: We may suspend or terminate your account at any time for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Consistently low-quality work
  • Inactivity for an extended period
  • At our discretion with or without cause

Effect of Termination: Upon termination, your right to access the Platform immediately ceases. We will pay you for accepted work completed before termination. Provisions that by their nature should survive termination will survive, including intellectual property licenses, confidentiality obligations, and dispute resolution terms.

14. Disclaimers and Limitations of Liability

NO WARRANTY: THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MAXIMUM LIABILITY: OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU EARNED THROUGH THE PLATFORM IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR $500, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Bolt, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Platform
  • Your Content or work submissions
  • Your violation of any third-party rights
  • Your violation of applicable laws

16. Dispute Resolution and Arbitration

Informal Resolution: Before filing a legal claim, you agree to try to resolve disputes informally by contacting us at disputes@bolt.com. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days, either party may initiate arbitration.

Binding Arbitration: Any dispute arising out of or relating to these Terms or the Platform will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes.

Class Action Waiver: YOU AND BOLT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Bolt agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

Location: Arbitration will take place in San Francisco County, California. For claims of $10,000 or less, you may choose whether the arbitration will be conducted solely on the basis of documents, through a telephonic hearing, or by an in-person hearing.

Exceptions: Either party may bring a lawsuit in court to enjoin infringement or other misuse of intellectual property rights.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

18. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bolt regarding the Platform and supersede all prior agreements.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without your consent to any affiliate or in connection with a merger, acquisition, or sale of assets.

Force Majeure: We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Notices: We may provide notices to you via email, regular mail, or postings on the Platform. Notices are deemed received when sent. You may provide notices to us at legal@bolt.com.
